29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about 12/05/2012, at the above referenced jobsite, the employer did not develop nor implement a hearing conservation to address an employee's exposure to noise at the facility. An employee was exposed to an 8-hour TWA exposure of 91.6 dBA (125.6% dose) during casting. The employee was monitored for 433 minutes and a zero dose was assumed for the 47 minutes of un-sampled time.
