29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired. (a) 49 Highland Avenue, front of home. The portable ladder used to access the roof had visible defects, in that the slip resistant foot was missing. The ladder was not tagged and removed from service, on or about 11/21/12. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards: (a) 49 Highland Avenue, front of home. An employee used a portable ladder with visible defects to access the roof of a residential home. The employee was not trained to recognize the fall hazards associated with portable ladder use, on or about 11/21/12. NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
