29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: At the front and side of the structure under construction, employees at ground level worked directly underneath employees working on wooden beams 9 feet above ground level without the benefit of having protective helmets (hard hats) to prevent being struck by dropped items and equipment.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Employees stood and worked from a wooden beam approximately 9 feet above ground level without fall protection while constructing the framing over a covered walkway at the front and side of a commercial building under construction.
