29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. At the time of the inspection, the employer was using electricity from a Miller portable welder for scaffold motors and lighting inside the west water tank without ground fault protection or an assured grounding program.

29 CFR 1926.452(p)(2): The platform was not securely fastened to hangers (stirrups) by U-bolts or by other means which satisfy the requirements of 1926.451(a). At the time of the scaffold collapse on 11/14/12, the wire rope cable used to support the center section of the scaffold pulled through the pipe holder on the roof of the tank allowing the scaffold to swing free and causing an emplyee to use a personal fall protection system which failed to prevent his fall to the floor below.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. At the time of the inspection, it was found that workers access the top of water tanks to install suspended scaffold systems and are exposed to a fall from the tank to ground of 30 feet. No fall protection system was in place. Workers could access the tank top by inside fixed ladder or aerial lift. Attachment points for personal fall protection could be used during installation of suspended scaffold system.

29 CFR 1926.502(d)(11): Liifelines shall be protected against being cut or abraded. At the time of the inspection, horizontal lifelines were threaded through steel pipe sleeves which then became vertical lifelines. Edges of the steel pipe were not protected to prevent cutting of the lifeline.
