29 CFR 1926.451(a)(6):     Scaffolds were not constructed in accordance with the design by a qualified person:    On or about November 29, 2012, on a scaffold, where the employer did not ensure that a competent person was on site to erect and approve the use of the incomplete scaffold that employees were observed working on.  This practice created conditions which exposed employee(s) to falling from an approximate elevation of 12 feet to the ground below.

29 CFR 1926.451(b)(1):     Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)    On or about November 29, 2012, the employer did not provide adequate planking or decking for the scaffolding used by employees.  Employees performing construction activities on a single story, commercial building, were working from three 2"H x 10"W x 12'L planks, on the 2nd level of scaffolding approximately 12 feet above ground level, without fall protection or guardrail protection.  This practice created conditions which exposed employee(s) to falling from an approximate elevation of 12 feet to the ground below.

29 CFR 1926.503(b)(1):     The employer did not verify fall protection training by preparing a written certification record:    On or about November 29, 2012, at the jobsite, the employer did not verify written certification for fall protection training for employees who were performing construction actitivites from heights greater than 10 feet without fall protection systems.

29 CFR 1926.503(c)(3):     Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  Note: The following appendices to subpart M of this part serve as non-mandatory guidelines to assist employers in complying with the appropriate requirements of subpart M of this part.  [59 FR 40738, Aug. 9, 1994; 60 FR 5131, Jan. 26, 1995]    On or about November 29, 2012, the employer did not ensure affected employees including, but not limited to the foreman and roofer were retrained in fall protection.  The employees had not retained the required understanding, knowledge, and skill of using fall protection systems which exposed them to fall of greater than 10 feet to the ground below.

29 CFR 1926.501(b)(10):     Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems or other means of fall protection:    Twin Brothers, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 314489121, citation number 1, item number 1 and was affirmed as a final order on December 23, 2010, with respect to a workplace located at 3204 Happy Valley Drive, Little Rock, Arkansas 72212.    On or about November 29, 2012, located at 105 Oak Street, Conway AR, employees were performing roofing activities on the low-sloped roof with no form of fall protection.  This condition exposed the employees to falls from a height of greater than 10 feet.
