29 CFR 1910.132(c): Personal protective equipment was not of safe design and construction for the work to be performed: On or about November 27, 2012, employees at Midwest Warehouse and Distribution System, Inc., in Naperville, Illinois, were wearing a waist belt and a retractable lanyard as a means of fall protection while operating a production picker-type powered industrial vehicle. The fall protection was neither a restraint device nor a proper fall-arrest system. Abatement certification is required of this item in accordance with the requirements of 29 CR 1903.19(c).

The vehicle had bare wires protruding from the steering column and damaged wheels which made the vehicle unstable when driven. The vehicle was examined at the beginning of the shift but was not taken out of service. DOCUMENTATION AND CERTIFICATION ARE REQUIRED FOR THIS ITEM.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): On or about November 27, 2012, employees at Midwest Warehouse and Distribution System, Inc., in Naperville, Illinois, operated a Toyota powered industrial vehicle, identified as Truck # 263. The vehicle was in need of repair because it had bare wires protruding from the steering column and because all of the vehicle's wheels were damaged and made the forklift unstable as it was driven. THE MIDWEST WAREHOUSE AND DISRIBUTION SYSTEM, INC, WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1910.178(p)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 452793, CITATION NUMBER 1, ITEM NUMBER 1B AND WAS AFFIRMED AS A FINAL ORDER ON OCTOBER 23, 2012, WITH RESPECT TO A WORKPLACE LOCATED AT 555 ST. JAMES GATE, BOLINGBROOK, IL 60440. DOCUMENTATION AND CERTIFICATION ARE REQUIRED FOR THIS ITEM.
