29 CFR 1910.95(b)(1): When employees are subjected to sound exceeding those listed in Table G-16, feasible administrative or engineering controls shall be utilized. If such controls fail to reduce sound levels within the levels of Table G-16, personal protective equipment shall be provided and used to reduce sound levels within the levels of the table. a. At the workplace, in the abrasive cutting area, the employer did not utilize feasible administrative or engineering controls when an employee was subjected to sound exceeding those listed in Table G-16. An employee was overexposed to continuous noise, while cutting steel pipe, at 136%, which exceeded the AL(action level) of 50%, an 8-hour TWA (time weighted average) sound level of 85 ,while cutting. The employee's 8-hour TWA sound level was approximately 92.2 during the 444 minute sampling period on December 13, 2012. Exposure calculations included a zero increment for the 36 minutes not sampled.

29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. At the workplace, in the abrasive cutting area, the employer did not administer a continuing and effective hearing conservation program. An employee was overexposed to continuous noise, while cutting steel pipe, at 136%, which exceeded the AL(action level) of 50%, an 8-hour TWA (time weighted average) sound level of 85 ,while cutting.
