OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the point of operation, ingoing nip points, rotating parts, due to: (a) 2 Club Road, Rye, New York. "Last chance cable" on left side of Bandit 250 Model Wood Chipper was missing preventing worker(s) from stopping and reversing the chipper in an emergency should they be drawn into the chipper. Among other, feasible and reasonable abatement methods to correct this hazard is for the employer to follow all the requirements as outlined in the American National Standard Institute's standard for Arboricultural Operations, (ANSI Z133.1-Revision 2006) Pruning, Repairing, Maintaining, and Removing Trees and Cutting Brush - Safety Requirements, specifically, but not limited to: a) Section 6.3 Brush Chippers, subsection 6.3.4 "A brush chipper equipped with a mechanical in-feed system shall have a quick stop and reversing device on the in-feed. The activating mechanism for the quick stop and reversing device shall be located across the top, along each side of, and close to the feed end of the in-feed hopper within easy reach of the operator."
