29 CFR 1926.651(d): Employees exposed to public vehicular traffic were not provided with a warning vest or other suitable garments marked with or made of reflectorized or high-visibility material: a) Route 46 East at Lakewood Drive, Denville, NJ. Employees working in and around the trench were exposed to struck-by injuries from vehicular traffic as they were not provided with high visibility vests or clothing. Violation observed on or about 10/24/2012.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal): a) Route 46 East at Lakewood Drive, Denville, NJ. Employees tapping into a water line were exposed to struck-by and crushing injuries from a cave-in, in the up to 5 foot, 11 inch deep trench which was not adequately sloped or protected by shields or shoring. Violation observed on or about 10/24/2012.. ALL TERRAIN EXCAVATING, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT 29 CFR 1926.652(a)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311242358 , CITATION NUMBER 1, ITEM NUMBER 3, ISSUED ON 12/13/2007, FINAL ORDER DATE 01/03/2008, WITH RESPECT TO A WORKPLACE LOCATED AT 840 ROUTE 46 EAST, LEDGEWOOD, NJ.
