OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck / crushed by the load. On or about 11/30/12 Location: 1 Blue Hill Plaza, Pearl River, NY 10965 a) Employees used a hand operated pallet jack to move a computer data storage cabinet, weighing approximately 2,500 lbs, from a tractor trailer to a straight truck, positioned back to back. The employees bridged the elevated lift gates of each truck and attempted to move the computer unit across the surface of the straight truck lift gate to the inclined surface of the tractor trailor lift gate, when the employees lost control of the unit causing it to tip over striking/crushing one of the employees. b) Employees used a hand operated pallet jack to move a computer data storage unit, weighing approximately 2,500 lbs, from a tractor trailor to a straight truck, positioned back to back. The employees bridged the elevated lift gates of each truck and attempted to move the computer unit across the surface of the lift gates causing the load not to be centered on the main section of a lift gate. Among other methods, the following feasible and acceptable abatement method to correct this hazzard is: 1) Avoid whenever possible moving loads up or down inclined surfaces. If employees must move a load down an inclined surface do not allow them to be in front of the load and pallet jack. 2) Keep the load centered on the main section of the platform as indicated in the owners manual 3) Lower lift gates to the ground before transferring the load from one lift gate to the other.
