29 CFR 1910.178(q)(1):     Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel:    (a) The Yale fork truck #27, serial number N522890, was not taken out of service when repairs were needed.  Pins needed to hold the forks in place were missing for both forks.  The knob used to shift the fork truck between forward and reverse was missing.  The brake cover was worn through to the point metal was showing;      (b) The Yale fork truck # 30, serial number N568324, was not taken out of service when repairs were needed.  A pin needed to hold one of the forks in place was missing, the pin needed to hold the other fork in place had a weak spring and could not be relied on to keep the fork from shifting;    (c) The Nissan fork truck #2 was not taken out of service when repairs were needed.  It was missing both pins used to hold the forks in place and those pins had been replaced by maintenance with two long thin bolts.  The fork truck was also missing a shift handle.  The oil light was broken.  The engine light was broken.  The seat belt was missing the locking end.  The gas pedal cover was missing.  And the clutch pedal cover was missing;    (d) The Yale electric fork truck #42, serial number F108V166287 was not taken out of service when repairs were needed.  It was missing both pins needed to hold the forks in place.  The break pedal cover was also missing; and    (e) The Yale fork truck #29, serial number N543057, was not taken out of service when repairs were needed.  It was missing both pins needed to hold the forks in place.

29 CFR 1910.178(q)(7):     Industrial trucks were being placed in services after the examination showed condition(s) adversely affecting the safety of the vehicle:      (a) The Yale fork truck #29, serial number N543057, was not taken out of service when repairs were needed. The locking pins for the forks were reported missing on November 20, 2012.  It was found still in service with the pins needed to hold the forks in place still missing on January 14, 2013;    (b) The Yale fork truck # 30, serial number N568324, was serviced on January 3, 2013 and again on January 10, 2013, but was returned to service twice still needing repairs.  A pin needed to hold one of the forks in place was missing, the pin needed to hold the other fork in place had a weak spring and could not be relied on to keep the fork from shifting;    (c) The Nissan fork truck #2 was serviced on December 10, 2012 and December 11, 2012, but was returned to service still needing repairs.  It was missing both pins used to hold the forks in place and those pins had been replaced by maintenance with two long thin bolts.  The fork truck was also missing a shift handle.  The oil light was broken.  The engine light was broken.  The seat belt was missing the locking end.  The gas pedal cover was missing.  And the clutch pedal cover was missing;    (d) The Yale electric fork truck #42, serial number F108V166287 was serviced on December 26, 2012 and again on December 31, 2012, but was returned to service.   It was missing both pins needed to hold the forks in place. Pins needed to hold the forks in place were missing for both forks.  The knob used to shift the fork truck between forward and reverse was missing.
