29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) Eastern Niagara Hospital, Old Keanon James Building, two (2) employees observed throwing throwing debris (old windows) out of a second floor window into rear of dump truck without adequate fall protection provided, there was no toprail provided and the employees were exposed to falls of seventeen (17) feet to the ground below. The wall extended twenty-four (24) inches off the floor. NO ABATEMENT CERTIFICATION REQUIRED
