29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound top-rail capacity). (a) Schaeffer Auditorium, Kutztown University - The employer did not ensure that the employees performing overhand bricklaying from a supported scaffold were protected on the ends by the use of a personal fall arrest system or guardrail system. The employees were exposed to a fall of approximately 18 feet 6 inches from the north end of the scaffold to the ground below on or about November 21, 2012. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.502(b)(2)(i): Midrails, when used, were not installed at a height midway between the top edge of the guardrail system and the walking/working level. (a) Schaeffer Auditorium, Kutztown University - The employer did not ensure that the 3/8 inch wire rope midrail which protected the edge of the first floor storeroom, behind the stage, was secured in place by approved clamps. The midrail was slack and employees were exposed to a fall of approximately 14 feet to the ground below on or about November 21, 2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
