29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were another provision in paragraph (b) of this section used to provide an alternative fall protection measure. On or about December 03, 2012, at a residential home under construction located at 14397 Early Morn, El Paso, TX., 79938, two employees were observed performing roofing work (with pitch 1:12) without proper fall protection. This condition exposed the two employees to fall hazards of approximately 21 feet to the ground below. HERIBERTO PRIETO DBA HP CONSTRUCTION WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD 1926.501(b)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313500209, CITATION NUMBER 01, ITEM NUMBER 001 AND WAS AFFIRMED AS A FINAL ORDER ON MAY 02, 2011, WITH RESPECT TO A WORKPLACE LOCATED AT 1937 SHREYA, EL PASO, TEXAS 79936.
