29 CFR 1910.178(l)(6):  The employer did not certify that each operator had been trained and evaluated as required by this paragraph (l).  The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation:    On or about December 4, 2012, and at times prior thereto, the employer did not maintain documentation of forklift operator training and did not certify forklift operator training for employees who operate them as a part of their jobs.

29 CFR 1910.178(q)(7):     Industrial trucks were not examined before being placed in service:     On or about December 4, 2012, and at times prior thereto, the employer did not ensure that the Yale forklift was inspected before each days work.  Written daily examinations of the forklift were not available. .

29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and maintain a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets (MSDS), and employee information and training will be met, and which also includes the following:      a)  A list of the hazardous chemicals known to be present using an identity that is referenced on the appropriate material safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and,  b)  The methods the employer will use to inform employees of the hazards of non-routine tasks (for example, the cleaning of reactor vessels), and the hazards associated with chemicals contained in unlabeled pipes in their work areas.    On or about December 4, 2012, and at times prior thereto, the employer did not maintain a written hazard communication program that included a list of hazardous chemicals in the workplace and information on employee training.
