29 CFR 1926.652(b)(1):     The slopes and configurations of sloping and benching systems selected to be used were not constructed in accordance with the requirements of paragraph (b)(1):    (a) High Side of Excavation - Employees installed forms and sprayed a recently poured bridge footing in a 12 foot deep trench that had one side benched and sloped while the other side was not benched or adequately sloped. Employees working on the footer on the high side were working 7-8 feet from the unshored wall of the excavation, thereby exposing the employees to a serious hazard, observed on or about 12-14-12.      Abatement certification required.
