OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while being elevated on a forklift.    a)  Establishment - Warehouse:    Employee(s) were elevated while standing on a wooden pallet on fork truck forks, thereby exposing employee(s) to a 12 foot fall hazard.     Violation occurred on or about October 1, 2012.       b)  Establishment - Warehouse:      Mobile ladder stands that had defects were not taken out of service. Two defective mobile ladder stands, with damaged and bent lower support bracing, were provided to employees to place and remove items from the racks.       Violation occurred on or about 12/3/2012.       c)  Establishment - Warehouse:      The employer did not provide a safe means of access for employees to access the the 3rd tier of the storage racks to place and retrieve boxed apparel product, thereby exposing employees to a fall hazard of approximately 12 feet above floor level.       Violation occurred on or about 12/1/2012.
