29 CFR 1926.453(b)(2)(iv):  Employee(s) working in an aerial lift were not standing firmly on the floor of the basket:    On the west exterior elevation of a building under renovation located at 900 North Federal Highway in Boca Raton, Florida:  Two employees performing painting operations approximately 30 ft. above a lower level from the basket of an aerial lift were standing on the midrail of that basket.

29 CFR 1926.454(a):  The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:    On site of a building under renovation located at 900 North Federal Highway in Boca Raton, Florida:  The employer did not provide a training program for employees performing painting operations from the basket of an aerial lift that would enable them to recognize the hazards of falling, on or about December 3, 2012.    PLEASE NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.

29 CFR 1926.502(d)(21):  Personal fall arrest systems were not inspected prior to each use for wear, damage, and other deterioration, and/or defective components were not removed from service:    On the west exterior elevation of a building located at 900 North Federal Highway in Boca Raton, Florida:  Safety harnesses and lanyards being used by employees performing painting work from the basket of an aerial lift did not inspect their personal fall arrest systems prior to using them. There were defects including but not limited to rusted hasps on the end of the lanyards that would not allow them to either open or automatically close when released, on or about December 3, 2012.

29 CFR 1926.502(d)(23):  Personal fall arrest systems were attached to guardrail systems or to hoists:    Employees performing painting work from the basket of an aerial lift approximately 30 ft. above a lower level had the lanyards of their personal fall arrest systems attached to the guardrail system of that lift and not to the anchor points provided on the lift by the manufacturer, on or about December 3, 2012.
