29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) Amware Distribution Warehouses M&M, LLC - Elyria, Ohio: On or about December 4, 2012, employees operated powered industrial vehicles to lift and/or maneuver equipment in the warehouse and distribution areas. The employer did not assure that each operator successfully completed a forklift operator training program containing elements in 29 CFR 1910.178(l) before the employee was permitted to operate the forklift. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

Employees were exposed to injury in that the horn was not operative. b) Amware Distribution Warehouses M&M, LLC - Elyria, Ohio: On or about December 3, 2012, the employer did not assure that the Toyota forklift (s/n 18450) was removed from service during a time in which it was not in safe operating condition. Employees were exposed to injury in that the horn was not operative. No additional abatement information is needed for this item.
