29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about November 27, 2012, on the south side of the construction site, an employee was exposed to a fall hazard of 12 feet while engaged in masonry activities from a roof overhang on a commercial construction site.

29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided. On or about November 27, 2012, on the south side of the construction site, an employee, engaged in masonry work, utilized the building exterior wall to egress the roof overhang. The employer did not provide a ladder to the employee exposing the employee to fall hazards.
