29 CFR 1926.451(a)(6): Scaffolds were not constructed in accordance with the design by a qualified person:     a) Water Tower, Suspended Scaffold -- On or about December 5, 2012, two employees were working from a New England Boom supported scaffold, when the single wire rope supporting the scaffold failed.  This scaffold was not constructed in accordance with the design developed by the Chicago Bridge & Iron Company and their related rigging guide.

29 CFR 1926.451(d)(12)(i):   A single point suspension scaffold did not have a minimum of 3 wire rope clips installed:  a) Water Tower, Suspended Scaffold - On or about December 5, 2012, employees were working on a single point New England Boom suspension scaffold when the upper loop of its 'cable eye' suspension line failed, causing the scaffolding to collapse, as the wire rope was inadequately secured with only a single Crosby fist grip clip and a single Crosby U-Bolt wire rope clip.

29 CFR 1926.451(d)(12)(ii): Wire rope clips used on suspension scaffold ropes were not installed according to the manufacturer's recommendations:  a) Water Tower, Suspended Scaffold - On or about December 5, 2012, the 'cable eye' suspension line of a single point suspension scaffold was constructed with wire rope clips that were installed in a manner contrary to the Crosby Group's user guide for installation, security, and tightening.    Abatement Note:  The use of fist grip clips and U-Bolt wire rope clips must be installed and maintained in accordance with the manufacturer's information regarding positioning, tensioning, and wire rope size compatibility.

29 CFR 1926.451(d)(12)(iv):   Wire rope clips on a single point suspension scaffold were not inspected and retightened to the manufacturer's recommendations at the start of each workshift after its initial loading:  a) Water Tower, Suspended Scaffold - On or about December 5, 2012, the suspension line of a single point suspension scaffold identified by the employer as a CB&I New England Boom failed, causing a collapse of the scaffold, after Crosby fist grip clips were not being inspected and retightened in accordance with the manufacturer requirements prior to the start of the workshift.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used.    a) Water Tower, Suspended Scaffold -- On or about December 5, 2012, an employee wearing personal fall arrest equipment had not received training on self rescue equipment and methods.  This employee did not use his available self rescue equipment while suspended by his shock absorbing lanyard which had been actuated during an arrested fall.

29 CFR 1926.1053(a)(16): The normal step across distance for through fixed ladders at their point of access/egress exceeded 12 inches (30 cm) and a landing platform was not provided with a step across distance of not less than 7 inches (18 cm) nor more than 12 inches (30 cm) as measured from the centerline of the steps or rungs to the nearest edge of the landing:    a) Water Tower, Exterior Entry Ladder -- On or about December 5, 2012, employees were using an extension ladder to access the a water tower's exterior mounted ladder cage that did not have a landing platform. This required the workers to step across more than 12 inches to reach the access point of a fixed ladder located no less than eight feet above grade, without any means of fall protection.
