29 CFR 1926.451(f)(7):     Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person.      a) A tubular welded frame scaffold that was erected along side the exterior North wall of a two and half story residential house was not erected by a competent person qualified in scaffold erection in that the lack of guardrails or equivalent means to protect worker from fall(s) while working at a heights greater than 10 feet was not addessed before use.

29 CFR 1926.454(a):     The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.      a) Employees who worked from tubular welded frame scaffold and who worked at heights greater than 14 feet and greater above the lower ground level were not trained to recognize the scaffold deficiencies such as missing guardrails before use.

29 CFR 1926.451(g)(1):     Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    a) Located alongside the North exterior wall of two and half story residential house, the employees were working from tubular welded frame scaffolding and standing on aluminum walk board set up near the top of that scaffolding. Employees were working on the house exterior window wood frame(s) from that scaffold and were not provided fall protection to the lower ground level in that no guardrails or alternative personal fall protection systems were utilized at a height of 14 feet and greater.
