29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    a) Southside of Interstate Highway 84, adjacent to westbound mile marker 154; on or about November 29, 2012,  and at times prior thereto, the employer's competent person did not inspect prior to allowing an employee to enter a 6' 4" deep excavation with nearly vertical walls to assemble PVC pipe.    NOTE: Abatement certification IS required for this item.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    a) Southside of Interstate Highway 84 adjacent to westbound mile marker 154; on or about November 29, 2012, and at times prior thereto, an employee was installing PCV pipe in an excavation 6' 4" deep with nearly vertical walls, without a means of protection.    Note: Abatement certification and documentation ARE required for this item.    Dan Lafferty Construction Company, Inc. was previously cited for a violation of the Occupational Safety and Health Standard which was contained in inspection number 313350423, citation 1, item 1 and was affirmed as a final order on April 7, 2010, with respect to a workplace located at Hwy 93 and Poleline Rd., Twin Falls, Idaho 83301.
