29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: On or about December 04, 2012, an employee was exposed to the hazards of being caught-in, while digging with a shovel in a excavation that was approximately 6 feet 8 inches deep by 8 feet 6 inches wide and 11 feet long without a ladder or other means to egress. THE AR UTILITIES & EXCAVATION, LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.651(C)(2), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 312852999, CITATION NUMBER 01, ITEM NUMBER 001 AND WAS AFFIRMED AS A FINAL ORDER ON 10/28/09 WITH A FINAL ABATEMENT DATE OF 10/28/09, WITH RESPECT TO A WORKPLACE LOCATED AT 2311 S.W. The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal): On or about December 04, 2012, an employee was exposed to the hazards of being caught-in, while digging with a shovel in a excavation that was approximately 6 feet 8 inches deep by 8 feet 6 inches wide and 11 feet long without cave in protection.
