29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. a) APM Marine Terminal; On or about December 5, 2012 and at times prior thereto the employer exposed employees to struck by hazards in that employees were allowed to operate powered industrial trucks where neither the backup alarms nor the flashing lights were working.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a) APM Marine Terminal; On or about December 5, 2012 and at times prior thereto the employer exposed employees to struck by hazards in that employees were allowed to operate powered industrial equipment prior to conducting a pre-trip inspection of the equipment. As a result, an employee was operating powered industrial equipment where the backup alarm and flashing light were inoperable.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a) APM Marine Terminal; On or about December 5, 2012 and at times prior thereto the employer exposed employees to struck by hazards in that employees were allowed to operate powered industrial trucks without the employer first ensuring that the employees were competent to operate the equipment as demonstrated by the completion of the required training and evaluation specified in the regulation. This would include but not limited to the differences between the truck and the automobile, vehicle inspection and maintenance, operating limitations, and any other operating instructions, warnings, or precautions listed in the operators manual.
