29 CFR 1910.146(c)(2): If the workplace contains permit spaces, the employer shall inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces:     Employees entering confined spaces such as a horizontal fiberglass tank approximately 20 feet in length and 12 feet in diameter were exposed to asphyxiation hazards. The employees were exposed in that they were not informed by an effective means or the posting of danger signs of the existence and location of the danger posed by the permit spaces.

29 CFR 1910.146(c)(4): If the employer decides that its employees will enter permit spaces, the employer shall develop and implement a written permit space program that complies with this section. The written program shall be available for inspection by employees and their authorized representatives:    Employees entering confined spaces such as a horizontal fiberglass tank approximately 20 feet in length and 12 feet in diameter were exposed to asphyxiation hazards. The employees were exposed in that a written permit space program was not developed and implemented to address the hazards associated with entering fiberglass tanks to apply a resin product.

The employees were exposed in that hazards, including but not limited to, vapors introduced when applying the resin product, were not evaluated before and during entry.

29 CFR 1910.146(d)(3): The employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations:    Employees entering confined spaces such as a horizontal fiberglass tank approximately 20 feet in length and 12 feet in diameter were exposed to asphyxiation hazards. The employees were exposed in that safe procedures were not implemented, including but not limited to, the evaluation of the atmosphere inside the fiberglass tank(s) to determine the presence of toxics, flammables or oxygen deficiency before and during the entry.
