29 CFR 1926.20(b)(1):    The employer did not initiate and maintain such programs as may be necessary to comply with this part:     An employee conducting siding work on an approximately 18 foot high house was exposed to falls due to working in an aerial lift without falls protection, and the employer did not initiate and maintain an accident prevention program to control and eliminate the hazards present at the jobsite in accordance with the OSHA regulations.

The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):                                                                       An employee working in an approximately 18 foot high basket of an aerial lift without a harness or a lanyard was exposed to fall  hazards and the employer did not initiate and maintain an accident prevention program to control and eliminate the hazards present at the jobsite in accordance with the OSHA regulations.

29 CFR 1926.453(b)(2)(v):     A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated    An employee was exposed to a fall of approximately 18 feet while working from a Genie Aerial Lift, and was not wearing harness and/or a body belt with an attached lanyard to the basket of the lift.
