29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) Work Site at Kuehne Chemical, 86 Hackensack Ave, Kearny, NJ: Employer designated as the competent person did not conduct an inspection of it prior to employees accessing it. Excavation had visible deficiencies, such as but not limited to, no protective cave-in system with a depth of approximately 8ft. Violation occurred on or about 12/06/2012. CONCRETE SYSTEMS INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311843544, CITATION NUMBER 01 ITEM NUMBER 01, ISSUED ON 05/09/2008 AND BECAME A FINAL ORDER ON 06/04/2008, WITH RESPECT TO A WORKPLACE LOCATED AT 217 NEWARK AVENUE, JERSEY CITY, NJ 07303.
