On or about December 4, 2012 - at the above addressed jobsite, the employer did not initiate and maintain an accident prevention program and/or safety and health program to comply with the regulations of this part which included, but were not limited to employee protection when exposed to scaffolding and falls.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:    a.  On or about December 4, 2012 - at the above addressed jobsite, an employee using a ladder jack scaffold was not trained to recognize the hazards associated with the use of such scaffolds, thereby exposing the employee to the hazards associated with falls.

29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section.    a.  On or about December 4, 2012 - at the above addressed jobsite, an employee was performing tuckpointing operations from a ladder jack scaffold more than twenty five (25) feet above the ground, that was not designed by a qualified person, thereby exposing the employee to a fall hazard.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.    a.  On or about December 4, 2012 - at the above addressed jobsite, an employee conducting tuckpointing operations from a ladder jack scaffold more than twenty five (25) feet above the ground was not provided with an access ladder, thereby exposing the employee to fall hazards.
