29 CFR 1926.652(b): The slopes and configurations of sloping and benching systems were not in accordance with the requirement options of 29 CFR 1926.652(b)(1), (b)(2), (b)(3), or (b)(4): (a) On or about November 29, 2012, at a job site located at 1201 NW Tullison Road in Kansas City, MO, an employee was observed to be working in a trench over 5 feet in depth that was not adequately sloped in conformance with the available options.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: (a) On or about November 29, 2012, at a job site located at 1201 NW Tullison Road in Kansas City, MO, an employee was observed to be using an extension ladder to climb out of a trench. The ladder side rails just reached the top of the trench wall and did not extend past the upper landing surface at least 3 feet as required by standard.
