29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: a) Facility Wide- The employer failed to develop, document and utilize machine specific procedures to control the potentially hazardous for machines such as, the Bailer and the Compactor, without the proper information on how to secure all sources of energy such as pneumatic, hydraulic, gravitational energy. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.178(l)(3)(ii): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) Back Room- The employer failed to ensure that all persons who operated powered industrial trucks, such as the Wave Truck, Crown Stacker, and Crown Motorized Pallet Jack, were competent to operate the vehicles as safely demonstrated through the completion of training that included specific instructing on workplace related topics such as, surface conditions, composition of loads to be carried, load stability, pedestrian traffic, narrow aisles and other restricted places, ramps and other sloped surfaces, closed environments and other areas where there may be poor ventilation, and other unique or potentially hazardous environmental conditions where the vehicles will be operated. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
