29 CFR 1926.100(a) Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns.    (a) North side of building. Employee was not wearing protective helmet and was exposed to being struck by overhead materials such as tools and shingles, while working directly below overhead work, on or about 12/9/12.    Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.501(b)(11) Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:    (a) North side of building. Employee was removing asphalt shingles from the roof of a single story commercial building with a pitch of approximately 6-12. Employee was not provided with a means of fall protection and was exposed to falling approximately 18 feet to the ground below; on or about 12/9/12.    Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.503(a)(1) The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    (a) Worksite, north side of building. Employee was exposed to falling 18 feet to the ground below while removing asphalt shingles from a single story commercial building. The employee was not trained to recognize the hazards associated with falling; on or about 12/9/12.    Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
