On or about November 21, 2012 - at the above addressed jobsite, employees removing asbestos containg tile and mastic did not use vaccuum cleaners with HEPA filters to collect all debris and dust containing ACM and PACM, thereby exposing the employees to asbestos hazards.

29 CFR 1926.1101(g)(8)(i): For removing vinyl and asphalt flooring materials which contain ACM or for which in buildings constructed no later than 1980, the employer has not verified the absence of ACM pursuant to paragraph (g)(8)(i)(I) of this section. The employer shall ensure that employees comply with the following work practices and that employees are trained in these practices pursuant to paragraph (k)(9) of this section: (D) All scraping of residual adhesive and/or backing was not performed using wet methods. A. On or about November 21, 2012 - at the above addressed jobsite, all scraping of adhesive and/or backing was not performed using wet methods, thereby exposing the employees to asbestos hazards.

On or about November 21, 2012 - at the above addressed jobsite, employees were not made aware of the ACM or PACM in the area in which tile and mastic removal was taking place, thereby exposing the employees to asbestos hazards.

29 CFR 1926.1101(k)(9)(i): The employer shall train each employee who is likely to be exposed in excess of a PEL, and each employee who performs Class I through IV asbestos operations, in accordance with the requirements of this section. Such training shall be conducted at no cost to the employee. The employer shall institute a training program and ensure employee participation in the program. A. On or about November 21, 2012 - at the above addressed jobsite, employees performing removal of asbestos containing floor tile and mastic were not trained on asbestos removal operations, thereby expsoing the employees to asbestos hazards.
