29 CFR 1926.1101(k)(3)(ii)(B): Duties of employers: Before work under this standard is performed employers of employees who will perfrom such work did not inform the following persons of the location and quantity of ACM and/or PACM present in the area and the precautions to be taken to insure that airborne asbestos is confined to the area. Employees who will perform such work and employers of employees who work and/or will be working in adjacent areas. a. On or about November 27, 2012 - at the above addressed jobsite, subcontractors employees were not informed of the location and quantity of ACM and/or PACM in the area and the precautions to be taken to insure that the airborne asbestos is contained to the area, thereby exposing the employees to asbestos hazards.

29 CFR 1926.1101(k)(5)(iii): The employer and/or building did not demonstrate that flooring material including associated mastic and backing does not contain asbestos, by a determination of an industrial hygienist based upon recognized analytical techniques showing that the material is not ACM. a. On or about November 27, 2012, at the above addressed jobsite, subcontractors employees were exposed to asbestos containing material when the employer did not demonstrate that the mastic was not asbestos, thereby exposing the employees to asbestos hazards.
