29 CFR 1926.451(b)(1):  Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):      a)  At the worksite, 103 West NASA Road One, Houston, Texas, on December 7, 2012, employees were installing cinder blocks to exteriro of the building from the second and third level of the fabricated frame scaffold.  Each level was only equipped with 4 plankes leaving a total gap of approximately 28 inches.  This condition exposed employees to falling through to the next lower level.

29 CFR 1926.451(e)(1):  When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access:    a)  At the worksite,at 103 West NASA Road One, Houston, Texas, on December 7, 2012, employees were installing cinder blocks from the first and second levels of the fabricated frame scaffold.  A ladder was not installed for access or egress exposing employees to falls of approximately 12.8 and 6.4 feet.

29 CFR 1926.451(g)(1)(vi):  Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity):    a)  At the worksite, 103 West NASA Road One, Houston, Texas, on December 7, 2012, three employees were installing cinder blocks from the second level of the fabricated frame scaffold to the building under construction.  The employees were not provided with any fall protection.  The employees were exposed to falls of approximately 13. 8 feet.
