29 CFR 1904.39(a): The employer did not orally report the death of an employee or the in-patient hospitalization of three or more employees because of a work-related incident[LOCATION] On or about [date of inspection], the employer failed to report to OSHA a work-related death/in-patient hospitalization of three or more employees.If you become aware of an incident required to be reported under 1904.39 through some other means other than an employer report, prior to the elapse of the 8 hour reporting period and an inspection of the incident is made, a citation for failure to report will normally not be issued. [Per CPL 02-00-135; II; B. 3] On or about December 10, 2012, an employee of Wrico Stamping of Texas suffered a fatal heart attack while engaged in painting a stamping machine in the production warehouse. The company did not report the fatality within 8 hours to the Occupational Safety and Health Administration.
