Equipment that would have been found damaged or defective was not taken out of service until repaired:    (a) 57 Fairfield Terr Longmeadow, MA: On or about December 6, 2012, employees were observed using a circular saw whose cord was damaged so that the current carrying wires were exposed.

When the tool is withdrawn from the work, the lower guard did not automatically and instantly return to the covering position:    (a) 57 Fairfield Terrace Longmeadow, MA: On or about December 6, 2012, employees were observed using a DeWalt 7 1/4 inch circular saw whose guard had been disabled with metal wire to remain in the open(unguarded) position throughout its operation.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system:    (a) 57 Fairfield Terr Longmeadow, MA: On or about December 6, 2012, an employee was oberved working from a porch roof installing siding on this residence more than 10 feet above the ground below without any fall protection as required by this subpart:    All Star Insulation & Siding Co., Inc was previously cited for a violation of a similar occupational health and safety standard, 29 CFR 1926.501(b)(11) which was contained in OSHA inspection number 315514299 which became final order on August 26, 2011 with respect to a violation at 13 Florence Rd in Easthampton, MA.    Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19(d)(1).
