29 CFR 1910.178(l):     Operators were not trained in the safe operation of powered industrial trucks:    On or about December 12, 2012 an employee was operating a rough terrain fork truck without being certified, exposing employees to the hazards associated with operating a rough terrain fork truck.    Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.451(c)(2)(v):     The employer used forklifts  to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied:Note:  Preamble to Subpart L promulgated new paragraph (c)(2)(iv) & (v) in final rule to provide guidance. Added provision requires that in the case of fork-lifts, the entire scaffold platform be secured to the forklift.      On December 12, 2012, employees were exposed to the hazards associated with a scaffold collapse as the employees worked from a scaffold platform that was not attached to the forks of a rough terrain fork truck.    Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.451(g)(4):     Guardrail systems installed to meet the requirements of this section did not comply with the provisions listed in subparagraphs (i) through (xv) of this paragraph.      On December 12, 2012, employees were not protected from a fall while working from a wood scaffold that didnot have a complete guardrail and was resting on the forks of a rough terrain fork truck, exposing employees to a fall hazard of approximately 22 feet.    Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.501(b)(13):     Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a)      On December 12, 2012, an employee was not protected from a fall while standing on the exterior top plate of a residential property, exposing the employee to a fall hazard of 22.4 feet.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
