Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing or entrapment hazards: On or about 12/12/12, in the Production Area, the Caterpillar forklift, Model GP25, Serial Number 5AM92283 R5751, was not equipped with a seatbelt, exposing the operator to a crushing or entrapment hazard. Pursuant to 29 CFR 1903.19, the employer must submit an abatement plan within 25 days describing the actions it is taking to ensure compliance, including a description of how these steps protect its employees from being crushed or entrapped by the forklift.

29 CFR 1910.212(a)(5): Fan blade guards, where the periphery of the blades was less than seven feet above the floor or working level, had openings larger than one half inch: (a) On or about 12/12/12, in the frame shop, Dayton agricultural fan, Model SLY24, which was less than seven feet above the floor, had a cover with openings that measured 1-inch wide x 2-inches long. Employees were exposed to the hazard of being struck by the fan blades.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (a) On or about 12/12/12, throughout the Production Area, the employer did not provide the information contained in Appendix D to 29 CFR 1910.134 to employees who were exposed to chemicals, such as, but not limited to, Aliphatic Glue. The employees were exposed to respiratory illnesses.
