29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. Employees were working from the work level platform of a scaffold approximately 14 feet 6 inches above a lower level installing siding. The scaffold being used did not have the work level fully planked and did not have guard rails or any other means of fall protection to protect against the hazard of falling. The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: Employees were working from the work level platform of a scaffold approximately 14 feet 6 inches above a lower level installing siding. The scaffold being used did not have the work level fully planked and did not have guard rails or any other means of fall protection to protect against the hazard of falling. Employee working on a scaffold were not trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part. Employees working from scaffold planks were exposed to falls of approximately 14 feet 6 inches. Employees were not protected against the hazard of falling.
