29 CFR 1926.651(f): A warning system such as barricades, hand or mechanical signals, or stop logs was not utilized when mobile equipment was operated adjacent to an excavation, when such equipment was required to approach the edge of an excavation, and the operator did not have a clear and direct view of the edge of the excavation: (a) On or about December 12, 2012, for the employees and other contractors working around a 5-foot deep unprotected trench, located at 101st Avenue SE and Highway 9, Leal, North Dakota.
