29 CFR 1910.178(l)(1)(ii):  The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial vehicle (PIV) safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l), prior to allowing the operation of the PIV:    On or about December 11, 2012, the employer had not conducted an evaluation of the powered industrial vehicle operators in the facility as required prior to allowing the use of the PIVs such as, but not limited to the Clarklift forklift, etc.

29 CFR 1910.1200(h):  Employees were not provided information and training as specified in 29 CFR 1910.1200(h)(1) and (2) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced into their work area:    On or about December 11, 2012, the employer had not provided employees training on hazardous materials/chemicals as, but not limited to the gasoline, diesel fuel, lubricants, and other applicable materials/chemicals used in the repair/storage area.    Elements of a Hazard Communication information and training program are:    Information to employees shall include:    1)  Any operations in their work area where hazardous chemicals are present.    2)  The location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and material safety data sheets.    Training for employees shall include:    3)  Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.)    4)  The physical and health hazards of the chemicals in the work area,    5)  The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to  be used.    6)  The details of  the hazard communication program developed by the employer, including an explanation of the labeling system and the material safety data sheet, and how employees can obtain and use the appropriate hazard information.

29 CFR 1910.132(d)(2):  The required workplace hazard assessment was not certified as being performed, identifying the person completing the assessment, and written certification of the date of the assessment:    On or about December 11, 2012 the workplace assessment, designed to identify personal protective equipment (PPE) needed by employees to prevent injury, was not performed.    NOTE:  The assessment shall be written, titled, dated and certified by signature.  The required documented training shall include the following:    1)	When PPE is necessary;  2)	What PPE is necessary;  3)	Limitations of the PPE;  4)	How to properly wear and use the PPE, and  5)	Inspection and care of the PPE
