29 CFR 1910.157(c)(4): The employer shall assure that portable fire extinguishers are maintained in a fully charged and operable condition and kept in their designated places at all times except during use:    On or about 12/13/2012, on the rear of Yale forklift #5, the employer failed to ensure that the portable fire extinguisher was maintained in operable condition; the handle was broken and the locking/safety pin was missing.

29 CFR 1910.157(e)(3): The employer shall assure that portable fire extinguishers are subjected to an annual maintenance check. Stored pressure extinguishers do not require an internal examination. The employer shall record the annual maintenance date and retain this record for one year after the last entry or the life of the shell, whichever is less. The record shall be available to the Assistant Secretary upon request:    Instance 1: On or about 12/13/2012, on Yale forklift #5, the employer failed to ensure that the portable fire extinguisher received an annual maintenance check.  The inspection tag was missing.    Instance 2: On or about 12/13/2012, on Yale forklift #6, the employer did not ensure that the portable fire extinguisher mounted to the cage was subjected to an annual maintenance check.  The inspection tag denoted that the last annual maintenance check was performed on 08/04/2011.

29 CFR 1910.305(a)(2)(v)(A): Branch circuits shall originate in an approved power outlet or panelboard:    Instance 1: On or about 12/13/2012, in the Greenhouse, the employer did not ensure that the power strips utilized to provide electricity to several strands of Christmas tree lights and tree-base speakers originated in an approved power outlet; used an extension cord in a mixed daisy-chain configuration to provide electricity to two (2) - six (6) outlet power strips connected in series.      Instance 2: On or about 12/13/2012, in the Greenhouse, the employer did not ensure that the power strips utilized to provide electricity to several strands of Christmas tree lights and tree-base speakers originated in an approved power outlet; used an extension cord in a mixed daisy-chain configuration to provide electricity to a ten (10) outlet power strip and a three (3) outlet power strip connected in series.

29 CFR 1910.157(c)(1): The employer shall provide portable fire extinguishers and shall mount, locate and identify them so that they are readily accessible to employees without subjecting the employees to possible injury:    On or about 12/13/2012, on the cage of Yale forklift #5, the employer failed to ensure that a portable fire extinguisher was mounted.  The mount was broken and the fire extinguisher lay on the back of the forklift, behind the driver's seat (adjacent to the propane cylinder).    LOWE'S HOME CENTERS, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, 29 CFR 1910.157(c)(1), WHICH WAS CONTAINED IN THE OSHA INSPECTION NUMBER 311528442, CITATION NUMBER 01, ITEM 001, ISSUED 04/02/2009, WITH RESPECT TO THE WORKPLACE LOCATED AT 120 E GLORIA SWITCH RD, LAFAYETTE, LA 70507.  THIS CASE WAS AFFIRMED AS A FINAL ORDER ON 11/03/2009.
