29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated. A. Dellinger Excavating, Inc. worksite located near 7106 Milan Road, Sandusky, Ohio: On or about December 13, 2012, the employer did not ensure the trench in which employees were working in was inspected by a competent person at the beginning of each workday and throughout the shift. The need for adequate and effective cave-in protection while working in the trench was not recognized. B. Dellinger Excavating, Inc. worksite located near 7106 Milan Road, Sandusky, Ohio: On or about December 14, 2012, the employer did not ensure the trench in which employees were working in was inspected by a competent person at the beginning of each workday and throughout the shift. The need for adequate and effective cave-in protection while working in the trench was not recognized.

Dellinger Excavating, Inc. worksite located near 7106 Milan Road, Sandusky, Ohio: On or about December 13, 2012, the employer did not ensure employees were adequately protected from cave-in hazards while performing excavating activities. Employees were exposed to a near vertical wall, approximately 9.00' in height, located on the south side of the trench while accessing the ladder to enter the trench box. B. Dellinger Excavating, Inc. worksite located near 7106 Milan Road, Sandusky, Ohio: On or about December 14, 2012, the employer did not ensure employees were adequately protected from cave-in hazards while performing excavating activities. Employees were exposed to a near vertical wall, approximately 9.00' in height, located on the south side of the trench while accessing the ladder to enter the trench box.

Dellinger Excavating, Inc. worksite located near 7106 Milan road, Sandusky, Ohio: On or about December 13, 2012, the employer failed to attain specific written approval from the manufacturer of the 8 x 20 trench shields stacked at the west end of trench. Employees were exposed to potential hazards due to the sheet piling installed on the west end of the shield which was placed against the spreader bars. B. Dellinger Excavating, Inc. worksite located near 7106 Milan road, Sandusky, Ohio: On or about December 14, 2012, the employer failed to attain specific written approval from the manufacturer of the 8 x 20 trench shields stacked at the west end of trench.
