29 CFR 1926.651(k)(1):     Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.    In accordance with 1926 Subpart P Appendix A (c)(3): Visual and manual analysis. The visual and manual analyses, such as those noted as being acceptable in paragraph (d) of this appendix, shall be designed and conducted to provide sufficient quantitative and qualitative information as may be necessary to identify properly the properties, factors, and conditions affecting the classification of the deposits.    (a) The employees did not conduct both a visual and manual analysis of the soil. A visual analysis was conducted but not a manual test. The employees were exposed to struck-by hazard and caught-in-between hazards while working in the excavations.

29 CFR 1926.20(b)(2):     Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    (a) There was not a competent person on site that provided inspections of the excavations. The employees were installing sewer and water lines and were working in excavations that did not have a protective system. The employees were exposed to struck-by and caught-in-between hazards.

29 CFR 1926.651(c)(2):     Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.    (a) The employees did not have a means of access and egress for an excavation. In the event of an emergency in the excavation, the employees would not have a safe means of egress.

29 CFR 1926.651(j)(2):     Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    (a) The employees were working in an excavation that had a pile of gravel at the edge of an excavation. The employees were installing a water and sewer line in an excavation and were exposed to a struck-by hazard.

29 CFR 1926.652(a)(1):     Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:    29 CFR 1926.652(a)(1)(ii):     Excavations are less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in.    (a) The employees did not have a protective system in the excavations when installing sewer and water lines. The employees were exposed to struck-by and caught-in-between hazards.
