OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that there were no seatbelts provided on the Caterpillar V-80-E Forklift being used to load dry lumber; nor was there a proper operator's seat-back provided. (a) Dry Lumber Storage (chicken) House to Yard where trucks are loaded - On or about December 13, 2012, employees were exposed to being crushed while operating the Caterpillar V-80-E Forklift, should it overturn, due to the absence of a seat, with seatbelts, conforming to the manufacturer's original design specifications. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO:

29 CFR 1910.219(e)(3)(i): Vertical and inclined belts shall be enclosed by a guard conforming to standards in paragraphs (m) and (o) of this section. (a) North wall of Sawmill Building, near the 70 saw - On or about December 13, 2012 employees were exposed to getting caught between the unguarded Napa B62 V-belt, the 16 3/4 inch diameter flywheel and the drive pulley of an unidentified brand air compressor, powered by a 5 horsepower Baldor electric motor, due to the absence of a belt/pulley enclosure guard.

29 CFR 1910.265(c)(30)(ii): Warning signals and spark arrestors. All vehicles shall be equipped with audible warning signals and where practicable shall have spark arrestors. (a) Throughout the sawmill and log yard - On or about December 13, 2012 employees were exposed to possible injury due to the absence of a functioning audible warning signal, i.e., horn, on the following equipment: (1) the Caterpillar 928-G Front-end Loader, (2) the Clark GPX55 Forklift, #803, and (3) the Caterpillar V-80-E Forklift.
