(a) Marburger Drive, Stony Brook, NY (Worksite), Trench - Employees pouring concrete into the electrical transmission feeder forms were working near and directly below the chute of the concrete truck without protective helmets, on or about December 13, 2012. 29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    (a) Worksite, Electrical Feeder Trench - Employees were pouring concrete into the electrical feeder duct bank forms in an unprotected trench, measuring approximately 450' L x 7' W x 6' D. Excavated material surcharges (spoil piles) were placed directly on the edges of the trench, exposing the employees to struck by and cave in hazards. The unsupported sides of the trench were not protected by sloping, benching, supporting, or shielding, on or about December 13, 2012.      NOTE: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
