OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees engaged in the collection of residential recycling materials were exposed to the hazard of falling from and/or being struck by the mobile recycling collection truck being used:    Location - Near the intersection of Humphrey and Pickwick Streets, Marblehead, MA  (a)  On or about 12/14/12, two employees rode on the riding steps of mobile recycling collection truck #491 while traveling in excess of 10 mph.    (b)  On or about 12/14/12, two employees rode on riding steps (of mobile recycling collection truck #491) that had a depth of less than eight inches and provided less than 220 square inches of surface area (7 inches x 31 inches).          (c)  On or about 12/14/12, two employees were not trained in the hazards and safe practices associated with standing on the riding step of mobile recycling collection trucks, such as, but not limited to, maximum travel speeds and ride with both hands on the handholds.    (d)  On or about 12/14/12, a driver was not trained in the hazards and safe practices associated with employees standing on the riding step of mobile recycling collection trucks including, but not limited to, maximum travel speeds.
