29 CFR 1904.39(a): 29 CFR 1904.39(a): An oral report of an employment accident resulting in a fatality or the inpatient hospitalization of three or more employees was not made within (8) hours after the occurrence to the nearest Area Office of the Occupational Safety and Health Administration or the OSHA toll-free central telephone number (1-800-321-OSHA). a. for the medical event which occurred at 13179 S US Hwy 301, Riverview, FL, on or about 12/05/2012. An employee experienced a medical event on or about 12/05/2012 and expired about 5:50pm. Management was aware of the employee's passing at about 5:50pm as well. The death (an apparent heart attack) was not reported to OSHA until 12/06/2012 at about 11:05am, about 17 hours later.
