29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights shall bear on base plates and mud sills or other adequate firm foundation. a) 487 Falling Water Boulevard, Fairhope AL 36532; On or about December 14, 2012 and at times prior thereto, the employer exposed employees to a 13.9' fall hazard in that employees were allowed to work from the top level of a two buck high scaffold where the scaffolding was erected on base plates without all the required mudsills at some locations. Other parts of the scaffolding had the fabricated frames erected directly on top of wooden mudsills (no base plates present). The scaffolding was located at the northwest face of the house. b) 487 Falling Water Boulevard, Fairhope AL 36532; On or about December 14, 2012 and at times prior thereto, the employer exposed employees to a 13.8' fall hazard in that employees were allowed to work from the top level of a two buck high scaffold where the scaffolding was erected on base plates without all the required mudsills. The scaffold was located at the west side of the house.

29 CFR 1926.452(c)(4): Where uplift can occur which would displace scaffold end frames or panels, the frames or panels shall be locked together vertically by pins or equivalent means. a) 487 Falling Water Boulevard, Fairhope AL 36532; On or about December 14, 2012 and at times prior thereto, the employer exposed an employee to struck-by /crushed-by hazards in that he did not ensure that the scaffolding frames were joined by pins or equivalent means. The scaffolding was exposed to uplift or separation due to the use of a Genie GTH-644 telescopic handler being used to lift materials to an employee working on the top level of the scaffolding. The exposed scaffolding was located on the western corner of the side of the house.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access. a) 487 Falling Water Boulevard, Fairhope AL 36532; On or about December 14, 2012 and at times prior thereto, the employer exposed employees to a 13.8' fall hazard in that employees were allowed to climb up the side supports of a two buck high scaffold without the use of a ladder or other means of safe access. The scaffold was located on the western corner at the side of the house. b) 487 Falling Water Boulevard, Fairhope AL 36532; On or about December 14, 2012 and at times prior thereto, the employer exposed employees to a 13.9' fall hazard in that employees were allowed to climb up the side supports of a two buck high scaffold without the use of a ladder or other means of safe access. The scaffold was located on the northwest face of the side of the house.

The scaffold was located on the northwest face of the house. b) 487 Falling Water Boulevard, Fairhope AL 36532; On or about December 14, 2012 and at times prior thereto, the employer exposed employees to a 13.8' fall hazard in that employees were allowed to work from the top level of a two buck scaffold without fall protection such as but not limited to guardrail systems, personal fall arrest systems, or safety net systems. The scaffold was located on the west side of the house. c) 487 Falling Water Boulevard, Fairhope AL 36532; On or about December 14, 2012 and at times prior thereto, the employer exposed employees to a 13.8' fall hazard in that employees were allowed to walk across planking without fall protection such as but not limited to guardrail systems, personal fall arrest systems, or safety net systems. Employees used the planking for transiting between top levels of the northwest and west scaffolding.
